1. Definitions

For the purpose of this policy:

  • “ESSENTIAL” refers to the company operating under the ESSENTIAL brand, including its affiliates, officers, employees, and suppliers.

  • “Customer” means the individual or entity purchasing or using an ESSENTIAL product.

  • “Product” includes any item sold under the ESSENTIAL brand, regardless of variation.

  • “Defect” refers exclusively to manufacturing-related flaws.

  • “Normal Use” refers to intended personal use as guided by official care instructions.

  • “Warranty Period” is defined as 12 months from the original date of purchase.

2. General Policy Statement

ESSENTIAL products are designed for durability and undergo strict quality control. However, minor variation or failure may still occur. This Limited Warranty outlines the exact scope of what may be covered. It does not imply blanket protection or entitlement.

3. Warranty Coverage — Scope & Limitations

3.1 Scope of Coverage
We warrant that ESSENTIAL products will remain free from defects in materials and craftsmanship for 12 months from the original purchase date, provided they are:

  • Purchased directly from ESSENTIAL or an authorised reseller

  • Used for non-commercial, personal purposes

  • Maintained under proper usage conditions

This warranty is non-transferable and void upon resale or unauthorised acquisition.

3.2 Covered Issues
Examples of eligible defects:

  • Faulty welds, seals, or threading

  • Lid or component failure under normal use

  • Manufacturing defects impacting basic function

ESSENTIAL reserves the right to determine what constitutes a valid claim.

4. Exclusions — What Is Not Covered

The following are not covered under any circumstance:

  • Accidental damage, impacts, or misuse

  • Heat, cold, chemical, or weather exposure

  • Dishwasher damage (unless expressly approved)

  • Cosmetic wear such as scratches or fading

  • Tampering, disassembly, or third-party repairs

  • Lost, stolen, or misplaced products

  • Commercial or extreme-use applications

  • Products purchased second-hand or through unauthorised channels

We reserve the right to reject any claim not aligned with intended personal use.

5. Claims Process — Steps & Requirements

5.1 Submitting a Claim
To initiate a claim, email support@essentialdrinkware.com within the warranty period. Include:

  • Description of the issue

  • High-quality photo/video evidence

  • Proof of purchase (order number or receipt)

Claims without full documentation will be rejected.

5.2 Evaluation
Claims are reviewed within 5 business days. We will inform you of:

  • Approval or denial

  • Additional requirements (if needed)

  • Any offered remedy

Submitting a claim does not guarantee replacement or compensation.

6. Approved Resolutions

If a claim is approved, ESSENTIAL may, at its discretion:

  • Replace the item with an identical or equivalent product

  • Issue a store credit equal to the product’s purchase value

We do not offer cash refunds under this warranty. Shipping fees may apply and are typically the Customer’s responsibility.

7. Limitation of Liability

To the maximum extent allowed by law, ESSENTIAL shall not be liable for:

  • Indirect or incidental losses (e.g. missed income, reputational harm)

  • Product misuse or personal injury

  • Delay, seizure, or courier failure

  • Failure to meet expectations regarding size, fit, or aesthetic

  • Claims resulting from third-party involvement

If any liability is established, it is strictly capped at the original product price.

8. Force Majeure

We are not responsible for delays or failure to fulfil obligations due to events outside our control, including:

  • Natural disasters, floods, fire

  • Government restrictions or embargoes

  • Pandemics, labor strikes, or supply disruption

  • Civil unrest or data infrastructure loss

These events suspend our obligations without penalty.

9. No Implied Warranties

All ESSENTIAL products are sold “as-is” and “as-available.” We disclaim all implied warranties, including:

  • Merchantability or fitness for purpose

  • Performance consistency or accuracy

  • Durability, lifespan, or compatibility

No employee or agent may modify or extend this warranty without written legal approval.

10. Jurisdiction & Dispute Resolution

By using ESSENTIAL products, you agree that:

  • All disputes will be handled individually (no class actions or collective claims)

  • Jurisdiction lies exclusively in Los Angeles County, California, USA

  • You waive any objection to venue or jurisdiction

Violations may result in counter-litigation or collections.

11. Policy Updates

This warranty may be updated without notice. The most recent version will always be available on our website. Continued product use implies acceptance of all updates.

12. Final Acknowledgement

By placing an order or using our products, you confirm that you:

  • Have read and understood this warranty in full

  • Agree to all stated terms, without exception

  • Waive rights to interpret, challenge, or contradict its provisions

  • Will not pursue claims that conflict with this document
